1. INTRODUCTION

Welcome to Fun with Candles.

These Terms and Conditions govern the use of our website, products and services. By accessing our website and placing an order, you agree to be bound by these Terms and Conditions.

Fun with Candles reserves the right to amend these Terms and Conditions at any time without prior notice.

All transactions are governed by the laws of the Republic of South Africa.

3. PRODUCTS AND SERVICES

We supply candle-making materials, fragrance products, candles, diffusers, bath and body products, gift items, décor products, custom-made products and related accessories.

Due to the handmade and artisanal nature of certain products, minor variations in colour, fragrance, texture, finish and appearance may occur and shall not be regarded as defects.

Product images are for illustrative purposes only and actual products may vary slightly.

4. PRICING

All prices displayed are in South African Rand (ZAR).

Prices are subject to change without notice.

In the event of a pricing error, Fun with Candles reserves the right to cancel the order and refund any payment received.

5. PAYMENT

Full payment must be received before any order is processed, manufactured, packed or dispatched unless otherwise agreed in writing.

Fun with Candles accepts payment through approved payment gateways and payment providers.

Customers acknowledge that third-party payment providers may charge transaction fees which are beyond our control.

6. ORDER ACCEPTANCE

An order is only deemed accepted once payment has been received and verified.

Fun with Candles reserves the right to decline, refuse or cancel any order due to:

Product unavailability
Pricing errors
Suspected fraud
Incorrect customer information
Payment verification issues
Abuse of company staff or systems

7. PROCESSING TIMES

Processing times displayed on the website are estimates only.

Delays may occur due to:

Supplier shortages
Manufacturing requirements
Power outages
Courier delays
Public holidays
Force majeure events
Circumstances beyond our control

Fun with Candles shall not be liable for losses resulting from processing or delivery delays.

8. COLLECTION ORDERS

Customers selecting Collection at checkout accept responsibility for collecting their order from the designated collection point.

Once notified that an order is ready for collection, the customer shall collect the order within 30 calendar days.

Failure to collect an order does not entitle the customer to a refund.

Should a customer request courier delivery after selecting Collection, courier charges shall apply and must be paid prior to dispatch.

Orders remaining uncollected after 30 days may be subject to storage, handling or restocking fees.

Orders remaining uncollected after 90 days may be deemed abandoned and forfeited.

9. SHIPPING AND DELIVERY

Shipping fees are calculated separately unless otherwise stated.

Delivery times are estimates only and are not guaranteed.

Fun with Candles shall not be responsible for delays caused by:

Courier companies
Customs authorities
Weather conditions
Public holidays
Industrial action
Acts of God

Risk passes to the customer upon delivery of the parcel to the courier.

Customers must ensure delivery details are accurate at the time of ordering.

Additional charges arising from incorrect delivery information shall be for the customer's account.

10. ORDER CANCELLATIONS

Orders may only be cancelled before processing has commenced.

Once processing, manufacturing, packing, labeling, customization or preparation has begun, Fun with Candles reserves the right to charge a reasonable cancellation fee.

Cancellation fees may include:

Payment gateway fees
Banking fees
Packaging costs
Labour costs
Administrative costs
Restocking fees
Material costs already incurred

Any cancellation fee shall be reasonable and proportionate to the actual costs incurred.

Approved refunds shall be processed after deduction of applicable cancellation fees.

11. CUSTOM AND PERSONALISED PRODUCTS

Custom-made, personalised, branded, made-to-order and special-order products cannot be cancelled, returned or refunded once production has commenced.

This includes:

Wedding favours
Corporate gifts
Branded candles
Custom labels
Personalised products
Products manufactured to customer specifications

12. RETURNS AND REFUNDS

Returns and refunds are governed by our Refund and Return Policy.

Products must be returned unused, in original packaging and in resalable condition.

Shipping fees are non-refundable.

Payment gateway fees and approved cancellation fees may be deducted from refunds where applicable.

13. DEFECTIVE OR INCORRECT PRODUCTS

Customers must inspect products upon receipt.

Claims relating to defective, damaged or incorrect products must be reported within 48 hours of receipt and accompanied by photographic evidence.

Fun with Candles reserves the right to inspect returned products before approving any refund, replacement or exchange.

14. NON-RETURNABLE PRODUCTS

The following products are non-returnable:

Custom-made products
Personalised products
Gift cards
Clearance items
Sale items
Opened fragrance oils
Opened diffuser products
Opened bath and body products
Used candles
Products damaged through misuse

15. WHOLESALE ORDERS

Wholesale orders may be subject to minimum order quantities.

Unless otherwise agreed in writing:

80% deposit is payable before production.
Balance is payable before collection or dispatch.

Deposits paid on custom wholesale orders are non-refundable once production has commenced.

16. PRODUCT SAFETY

Customers are responsible for using all products safely and according to instructions provided.

Fun with Candles shall not be liable for injury, loss, damage or claims arising from misuse, improper storage or failure to follow safety instructions.

17. CANDLE SAFETY

Candles must never be left unattended while burning.

Customers assume full responsibility for the safe use of candles.

Fun with Candles shall not be liable for damage caused by improper candle use.

18. FRAGRANCE OILS AND RAW MATERIALS

Customers purchasing raw materials acknowledge that product performance may vary depending on formulation methods, environmental conditions and manufacturing processes.

Fun with Candles does not guarantee specific performance results when products are used in customer formulations.

19. INTELLECTUAL PROPERTY

All website content, logos, graphics, images, text, product descriptions and branding remain the property of Fun with Candles.

No content may be copied, reproduced or distributed without written permission.

20. CHARGEBACKS

Customers agree to contact Fun with Candles first to resolve any dispute before initiating a chargeback.

Where goods have been processed, manufactured, packed, dispatched or collected, Fun with Candles reserves the right to dispute chargebacks and recover all associated costs.

21. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Fun with Candles shall not be liable for any indirect, incidental, special or consequential damages arising from the use of its products, website or services.

Nothing in these Terms shall limit any rights afforded to consumers under applicable South African consumer protection legislation.

22. FORCE MAJEURE

Fun with Candles shall not be liable for any delay or failure to perform its obligations due to events beyond its reasonable control, including but not limited to:

Natural disasters
Fire
Flood
War
Civil unrest
Power failures
Internet outages
Supplier failures
Government restrictions

23. GOVERNING LAW

These Terms and Conditions shall be governed by the laws of the Republic of South Africa.

Any dispute shall be subject to the jurisdiction of the South African courts.
